Workers at Apple's Grand Central Terminal store are moving toward a union vote

Apple Store employees at the company’s flagship Grand Central Terminal location have begun collecting signatures to form a union, according to The Washington Post. In a recent update to their website, the organizers leading the effort say they voted on February 21st to affiliate themselves with Workers United. That’s the same labor union that has helped Starbucks employees across the US unionize.

“Grand Central is an extraordinary store with unique working conditions that make a union necessary to ensure our team has the best possible standards of living in what have proven to be extraordinary times with the ongoing COVID-19 pandemic and once-in-a-generation consumer price inflation,” the group, known as the Fruit Stand Workers United, said.

Apple declined to tell The Post whether it would support the unionization effort. Those involved in the drive accused the company of employing “union busting” tactics, including messaging that has tried to convince workers that unionization is against their best interests.

“We are fortunate to have incredible retail team members and we deeply value everything they bring to Apple,” a spokesperson for the company told The Post. “We are pleased to offer very strong compensation and benefits for full time and part time employees, including health care, tuition reimbursement, new parental leave, paid family leave, annual stock grants and many other benefits.”

Apple operates more than 270 stores in the US alone. According to The Post, at least three other retail locations are in the process of attempting to form a union. Organizers at the company’s Grand Central location are handing out signature cards. If at least 30 percent of the store’s workers say they’re interested in exploring unionization, Fruit Stand Workers United can petition the National Labor Relations Board to hold an election. 

Amid a pandemic that has had a disproportionate effect on essential workers, many workplaces across the US have begun to unionize, including, most notably, Amazon’s JFK8 fulfillment center on Staten Island. At the start of April, a majority of workers at the warehouse voted to form the first-ever Amazon union. The effort was successful despite the company spending $4.3 million on anti-union consultants in 2021.

Amazon accused of ramping up anti-union efforts ahead of another warehouse election

Amazon is said to have intensified its anti-union efforts ahead of a union election at a warehouse later this month. The Amazon Labor Union told Motherboard the company is mandating daily anti-union meetings at LDJ5, a facility in Staten Island, New York. It's also said to have distributed anti-union literature and disciplined a leader of the drive for organizing on the warehouse floor. What's more, ALU says Amazon has hired anti-union consultants to pose as employees.

Workers at the warehouse, which reportedly has around 1,500 employees, are scheduled to begin a union election on April 25th. Amazon's anti-union efforts ramped up in recent days, according to the report. The ALU recently won an election at a nearby facility, JFK8, which became the first Amazon warehouse in the US to formally unionize. Amazon plans to appeal the union's victory.

Amazon and the National Labor Relations Board in December reached a deal in December, under which the company agreed to inform past and current warehouse workers in the US of their right to organize. The terms of the agreement afforded workers more leeway to organize in break rooms, which is said to have been a key factor in ALU's success at JFK8.

However, Amazon reportedly isn't sticking to those terms at LDJ5. The ALU said the company removed pro-union literature from the break room and took down a pro-union banner after the JFK8 election result became clear. A lawyer representing ALU workers has filed unfair labor practice charges against Amazon for removing the banner and allegedly retaliating against a worker to stifle unionization efforts.

Amazon has long been accused of cracking down on workers' attempts to organize. Last year alone, it spent $4.3 million on anti-union consultants. The company's also said to be working on a chat app for workers, in which terms like "union" and "pay raise" are on a blocklist.

The NLRB said the company illegally interfered in a union election in Bessemer, Alabama last year and called for a rerun. However, the Retail, Wholesale and Department Store Union claimed Amazon interfered in the second election as well. The result of that vote hinges on a court hearing over challenged ballots.

Amazon is planning to appeal Staten Island union’s victory

Amazon will reportedly object to a recent union election victory at its warehouse in Staten Island, alleging that organizers pressured workers into voting to organize. The Wall Street Journal reported that the company revealed its intention to appeal JFK8’s election in a legal filing released to the public on Thursday. Roughly 55 percent of workers at the JFK8 warehouse voted to join the Amazon Labor Union, the first victory of its kind for Amazon workers in the US. The company has until April 22nd to gather evidence and formally file its objections to the National Labor Relations Board (NLRB).

In the document, Amazon gave a preview of what objections it plans on raising. The company wrote that it believes that the union threatened employees unless they voted to unionize. Some may think this is a fairly ironic move on Amazon’s part, considering NLRB accused the company of threatening employees unless they did the opposite. Amazon also accused the union of “electioneering” or interfering while employees waited in line to vote. It argued that unusually long waits at polling booths led to insufficient voter turnout. The company also believes organizers loitered by the polling area and intimidated voters, even going as far as to threaten immigrant employees with the loss of their rights if they didn’t vote to unionize.

Eric Milner, an attorney who represents the ALU, believes that Amazon’s objections will be dismissed. "To say that the Amazon Labor Union was threatening employees is really absurd," Milner said to Reuters. "The Amazon Labor Union is Amazon employees."

Meanwhile, a separate labor union attempting to organize an Amazon facility in Alabama filed its own objections on Thursday regarding the pending results of its recent rerun election. The Retail, Wholesale and Department Store Union (RWDSU) is accusing Amazon of “countless attempts to intimidate workers” in the Bessemer plant, including firing or suspending workers who supported the union. The results of that election are currently too close to call and will be determined in the coming weeks by an NLRB hearing over several hundred challenged ballots.

“Amazon’s behavior must not go unchallenged, and workers in Bessemer, Alabama must have their rights protected under the law. We urge the NLRB to carefully review our objections and ensure no company, not even with the bottomless pockets of Amazon, is allowed to act above the law,” said RWDSU president Stuart Appelbaum in a statement.

Google Fiber workers successfully Unionize in Kansas City

In a tally with the National Labor Relations Board (NLRB) this afternoon, Google Fiber customer service workers — jointly employed by Google parent Alphabet and staffing agency BDS Connected Solutions — voted 9 to 1 to form a union. They'll be represented by the Alphabet Workers Union, an arm of the Communications Workers of America.

Workers at the store, which operates out of Kansas City, Missouri, told Engadget back in January that they were feeling left out of important workplace conversations, especially around safety and staffing.

Second Amazon warehouse in Staten Island sets union election date

A second Amazon warehouse in Staten Island, New York will vote on whether to form a union, reported CNBC. The outcome of the vote, scheduled to begin on April 25th and last until May 2nd, will decide whether employees at the LDJ5 facility join the Amazon Labor Union, an independent, worker-led movement formed last year in Staten Island. Roughly a mile away, another Staten Island Amazon warehouse (known as JFK8) is set to hold its own union election next week.

Both elections are the latest development in a battle with Amazon on one side, unions and Amazon warehouse workers on the other side, and the National Labor Relations Board (NLRB) serving as the referee. NLRB ordered a re-run of a union election held at an Amazon warehouse in Alabama after determining that the tech giant illegally interfered in the vote. Votes for that election are scheduled to be counted on March 28th. 

Earlier this week, NLRB sued Amazon over the termination of Gerald Bryson, an employee of the JFK8 facility, who the agency believes was fired in retaliation for his activism. According to a tweet by ALU, Bryson’s employment at Amazon appears to have been reinstated after a federal judge complied with NLRB’s request to issue an injunction.

Staten Island workers have accused Amazon of union-busting and actively targeting workers involved in the union. Last month the NYPD arrested three labor organizers at the JFK8 facility — including ALU president Chris Smalls — after an Amazon manager complained that they were trespassing, reported The Daily Beast.

Amazon accused of interfering in Alabama union rerun election

The union that wants to represent workers at Amazon’s BHM1 facility in Bessemer, Alabama is accusing the company of once again violating the National Labor Relations Act. In an email the Retail, Wholesale and Department Store Union (RWDSU) sent Tuesday, it said it would file Unfair Labor Practice charges against the retailer.

Specifically, the organization alleges Amazon broke the law by removing pro-union posters put up by members of BAmazon, and implementing a new rule that limits the amount of time workers can spend inside the facility to 30 minutes before and after their shift. Additionally, the RWDSU alleges Amazon forced workers to attend anti-union meetings. If the NLRB finds Amazon’s actions violated the law, the union could then challenge the result of the ongoing second election at BHM1. That vote is currently scheduled to conclude on March 28th.

“While we haven’t seen today’s filing yet, we’re confident that our teams have fully complied with the law. Our focus remains on working directly with our team to make Amazon a great place to work," Amazon spokesperson Kelly Nantel told Engadget.

Last April, BHM1 became the first large Amazon facility in the US to hold a union vote. While workers there voted decisively against forming a union, the RWDSU went on to successfully challenge the vote. The NLRB ruled the company had illegally interfered with the vote and called for a rerun of the election to be held. Whether Amazon wins or loses the second election at Bessemer, it could be months before the NLRB makes a decision on the latest allegations from the RWDSU. That could set the stage for a protracted labor battle at the facility. 

Amazon union buster reportedly warned workers that they could get lower pay

An Amazon union avoidance officer has reportedly told workers at the company's JFK8 warehouse that there's a possibility they could get lower pay than what they're currently getting if they unionize. Motherboard has obtained an audio recording of a mandatory anti-union meeting that happened on Wednesday, wherein the officer could be heard describing the collective bargaining process. "The negotiation phase of the process is called collective bargaining, and in the negotiation, there are no guarantees. You can end up with better, the same, or worse than you already have," the officer said. 

An employee then cuts in and asks what they mean that workers could end up with worse, and the officer responds that there are no guarantees what would happen: "We can't promise what's going to happen. Amazon can't promise you that they're going to walk into negotiations and that the negotiations will start from the same [pay and benefits workers have already]. They could start from minimum wage for instance. I don't think that will happen, but it's a possibility." 

"So you're saying that Amazon’s gonna say..." the worker said, to which the officer responded: "I just said I'm not saying that." When the worker asked "So why put that out there?," the officer completely changed the topic. In addition, the officer also talked about how workers will be liable to pay union dues if they unionize and that there's no limit to how much they could be charged in New York. The election will have "significant and binding consequences not just for yourselves but for future associates, your coworkers, and potentially for your family," they warned. 

Frank Kearl, the lawyer representing workers at JFK8, told Motherboard:

"The [union avoidance consultant] makes the threat and tries to walk it back but once you’ve poisoned the well you can’t take it back. Even though she realized she made a mistake in making the threat, it doesn’t mean the threat wasn’t made and heard by all the workers who were forced to sit in on that session. It's against the law and an unfair labor practice to make a threat of reprisal.”

The National Labor Relations Board had previously accused Amazon of threatening, surveilling and interrogating workers at its JFK8 warehouse to discourage them from unionizing. A union avoidance consultant reportedly told them back then that organizing at the warehouse would fail anyway, because the organizers were "thugs." Amazon denied the allegations. 

The Amazon Labor Union, which is an independent group seeking to represent workers in the company, successfully collected enough signatures at JFK8 in its second attempt to unionize. Amazon and the ALU have reached an agreement to hold an in-person union vote at the facility between March 25th and March 30th. 

Amazon workers at a Staten Island warehouse will hold a union election in March

Amazon workers at a warehouse on Staten Island in New York will hold a union vote next month. Derrick Palmer of the Amazon Labor Union (ALU), an independent group that's seeking to represent workers at JFK8, says the election will take place in person between March 25th and March 30th.

The workers refiled a union petition with the National Labor Relations Board in December after failing to obtain enough signatures in their previous attempt. This time around, the workers reached the union vote threshold, which is usually 30 percent of a workforce. More than 5,000 workers are employed at JFK8.

The NLRB has accused Amazon of threatening, surveilling and interrogating workers at JFK8 to dissuade them from unionizing. A union avoidance consultant reportedly called organizers "thugs" and said the union drive would fail.

Earlier this month, workers at another Staten Island warehouse called LDJ5 filed a petition with the NLRB to unionize with the help of the ALU.

Another union vote is taking place at a facility in Bessemer, Alabama. The NLRB ordered a second election at BHM1 after it determined Amazon interfered in the first vote, in which a majority of employees voted against unionization. Votes will be counted starting on March 28th. Last month, a union supporter at the warehouse accused Amazon of retaliating against him.

Amazon allegedly called union organizers 'thugs' to discourage workers from unionizing

The National Labor Relations Board has accused Amazon of threatening, surveilling and interrogating workers at its JFK8 warehouse in New York to discourage them from unionizing. According to the board's complaint as seen by Motherboard, Amazon brought a union avoidance consultant to the facility and told employees that it "would be futile for them to select the Union as their bargaining representative." The consultant reportedly said that union organizing at the warehouse would fail anyway, because the organizers were "thugs."

NLRB's complaint also said that Amazon representatives interrogated workers about union activities and promised to fix their issues if they didn't support the union and didn't distribute union literature. Further, the labor board alleges that security guards confiscated union literature from workers and told them they couldn't distribute the materials without permission. If you'll recall, Amazon's warehouse workers in New York filed a petition to unionize with the board last year, but they had to withdraw it after failing to gather enough signatures to be approved. The JFK8 workers re-filed their application in December and recently reached union vote threshold.

Amazon spokesperson Kelly Nantel denied the allegations to Motherboard, telling the publication: "These allegations are false and we look forward to showing that through this process."

These allegations come from a series of unfair labor practice charges filed by workers in May and June last year. The board investigated the incidents and found merit that they occurred. It has given Amazon February 10th to respond to the complaint and has set a hearing for it on April 5th. In addition to detailing workers' allegations in its complaint, the NLRB has also outlined a series of remedies it wants the company to follow. In particular, it wants Amazon to train its managers, supervisors, security guards and union avoidance consultants on workers' rights to organize and form unions. 

US labor board says Amazon illegally fired union organizer in New York

The National Labor Relations Board (NLRB) has determined that Amazon illegally fired former worker Daequan Smith for trying to unionize its warehouses in Staten Island, New York. Smith, who was one of the organizers for the Amazon Labor Union (ALU), was fired in October 2021. The group filed an unfair labor practices complaint with the NLRB after his dismissal, accusing the company of illegal retaliatory firing over Smith's outspoken support for unionization. Now, according to Bloomberg, the board has found merit in the group's allegations and plans to issue a formal complaint against the e-commerce giant if the case doesn't settle. 

The Amazon Labor Union is made of up of former and current company workers and is an independent group not connected with major national unions. While the group failed to unionize Amazon's fulfillment centers in Staten Island last year, it refiled an application with the NLRB in December — a hearing is scheduled for that request next month. 

Smith wasn't the only ALU organizer that Amazon had fired. ALU president Chris Smalls also lost his job after he held a walkout at Amazon's JFK8 facility over the e-commerce giant's handling of COVID-19 safety at the warehouse in 2020. Amazon explained back then that Smalls "received multiple warnings for violating social distancing guidelines."

The company has been adamantly anti-union and had once told Engadget in a statement that it doesn't "think unions are the best answer for [its] employees." It added: "Every day we empower people to find ways to improve their jobs, and when they do that we want to make those changes — quickly. That type of continuous improvement is harder to do quickly and nimbly with unions in the middle." After reaching a deal with the NLRB in December, though, Amazon agreed to informs workers that they have the legal right to join, form or assist with a union through notices posted in workplaces, as well as on its mobile app and internal website.

As Bloomberg explains, NLRB brings complaints to agency judges if it finds merit in claims made by workers. The board's top prosecutor, Jennifer Abruzzo, one said she will "aggressively" seek court injunctions to get illegally fired employees back to work. ALU vice president Derrick Palmer, whom Amazon had disciplined for joining Smalls' COVID-19 protest, said Smith being reinstated would be a huge support for the group: "It would be monumental for him to go back to the same building that he was terminated from and speak his truth and let workers know that it’s OK to speak out."
