More news organizations sue OpenAI and Microsoft over copyright infringement

Legal claims are starting to pile up against Microsoft and OpenAI, as three more news sites have sued the firms over copyright infringement, The Verge reported. The Intercept, Raw Story and AlterNet filed separate lawsuits accusing ChatGPT of reproducing news content "verbatim or nearly verbatim" while stripping out important attribution like the author's name.

The sites, all represented by the same law firm, said that if ChatGPT trained on copyright material, it "would have learned to communicate that information when providing responses." Raw Story and AlterNet added that OpenAI and Microsoft must have known that the chatbot would be less popular and generate lower revenue if "users believed that ChatGPT responses violated third-party copyrights." 

The news organizations note in the lawsuit that OpenAI offers an opt-out system for website owners, meaning that the company must be aware of potential copyright infringement. Microsoft and OpenAI have also said that they'll defend customers against legal claims around copyright infringement that might arise from using their products, and even pay for incurred costs.

Late last year, The New York Times sued OpenAI and Microsoft for copyright infringement, saying it "seeks to hold them responsible for the billions of dollars in statutory and actual damages". OpenAI asked a court to dismiss that claim, saying the NYT took advantage of a ChatGPT bug that made it recite articles word for word.

The companies also face lawsuits from multiple non-fiction authors accusing them of "massive and deliberate theft of copyrighted works," and by comedian Sarah Silverman over similar claims.

LG's latest OLED evo TVs start at $1,500 and go up to a sky-high $25,000

LG unveiled its 2024 OLED evo TVs in January at CES 2024 promising extra brightness and other features, and we're now learning the prices for its best models. They'll start at $1,500 for the mid-range C4 models and go up to an impressive $25,000 for the 97-inch G4 flagship. 

First, here's what you're getting. The big theme this year was AI and the company's latest Alpha 11 processor is supposed to boost graphics performance by 70 percent, but it'll only be found in the high-end G4 series. The C4 models, meanwhile, will get the updated Alpha 9 Gen 7 chip. Both promise improved brightness (150 percent for the G4 compared to the G3), along with more AI features like upscaling.

Both chips, when paired with compatible LG soundbars, will be able to transmit wireless, lossless Dolby Atmos audio, letting consumers get high-quality surround sound with less hassle. 

Brightness levels on the new models are hitting nearly 1,000 nits — still not as bright as Mini LED TVs but far better than past OLED models. In addition, both the C4 and G4 and now support 144Hz refresh rates (with both G-Sync and AMD Freesync compatibility), so they'll be better options for PC gamers. 

Now that you know the lineups better, here are the models and prices. The G4 series comes in five sizes, 55, 65, 77, 83 and 97 inches priced at $2,600, $3,400, $4,600, $6,500 and $25,000. The C4 models, meanwhile, are offered in six sizes :42, 48, 55, 65, 77 and 83 inches priced at $1,500, $1,600, $2,000, $2,700, $3,700 and $5,400 respectively. 

They're certainly not the cheapest OLED TVs out there, but the extra brightness, along with other OLED benefits like inky blacks, will no doubt tempt the right buyers. The new models will ship in late March, and as a sweetener, LG is throwing in some goodies for any pre-orders made prior to March 17: a free LG Smart Cam, 5 percent back in membership rewards and free wall mounting or TV stand setup.

Amazon accused of using AI to 'replicate the voices' of actors in Road House remake

Amazon is being sued by the writer of the original 1989 Patrick Swayze version of the film Road House over alleged copyright infringement in the movie's remake, The Los Angeles Times has reported. Screenwriter R. Lance Hill accuses Amazon and MGM Studios of using AI to clone actors' voices in the new production in order to finish it before the copyright expired. 

Hill said he filed a petition with the US Copyright Office in November 2021 to reclaim the rights to his original screenplay, which forms the basis of the new film. At that point, the rights were owned by Amazon Studios, as part of its acquisition of MGM, but were set to expire in November 2023. Hill alleges that once that happened, the rights would revert back to him. 

According to the lawsuit, Amazon Studios rushed ahead with the project anyway in order to finish it before the copyright deadline. Since it was stymied by the actor's strike, Hill alleges Amazon used AI to “replicate the voices” of the actors who worked in the 2024 remake. Such use violated the terms of the deal struck between the union and major studios including Amazon. 

The claim is complicated by the fact that Hill signed a "work-made-for-hire" deal with the original producer, United Artists. That effectively means that the studio hiring the writer would be both the owner and copyright holder of the work. Hill, however, dismissed that as "boilerplate" typically used in contracts. 

The lawsuit seeks to block the release of the film, set to bow at SXSW on March 8th before (controversially) heading direct to streaming on Prime Video on March 21. 

Amazon denies the claims, with a spokesperson telling The Verge that "the studio expressly instructed the filmmakers to NOT use AI in this movie." It added that if AI was utilized, it was only done in early versions of the films. Later on, filmmakers were told to remove any "AI or non-SAG AFTRA actors" for the final version. It added that other allegations are "categorically false" and that it believes its copyright on the original Road House has yet to expire.

AMD's budget version of the 7900 XT GPU is coming to the US for $549

AMD will start selling the Radeon RX 7900 GRE (Golden Rabbit Edition) graphics card in the US, offering users a detuned version of its 7900 XT flagship for $549. For a savings of around $350 over the latter, it has performance on par with NVIDIA's RTX 4070 Super for some games at some settings, according to AMD. 

It offers impressive specs for that sum, including a Navi 31 XL GPU with 80 compute units (5120 stream processors), 160 AI accelerators and 16GB of GDDR6 memory. That's just a bit less than the 20GB of GDDR6, 96 compute units and 168 AI accelerators in the 7900 XT. With that, it offers 26 to 46 FP32 TFLOPS, a bit lower than the 700 XT's 32 to 51.6 FP32 TFLOPS. However, that means it also consumes less power — 260W TGP compared to the XT's 315W. 

All of that should make it a powerhouse at its 1440p resolution sweet spot. AMD claims it offers 14 percent more FPS per dollar at 1440p settings than the $549 RTX 4070 12GB. That includes games like Call of Duty Modern Warfare 3, Cyberpunk 2077 and others at 4K. In some settings (comparable DLSS/FSR modes), it outperforms the NVIDIA RTX 4070 Super, AMD claims.

At the same time, the 7900 GRE comes with new AI accelerators as part of the unified AMD RDNA 3 compute unit. With 160 AI accelerators and 16GB of DDR6 memory, it can generate Stable Diffusion images in less than a second, AMD said, or let you load your own large language model (LLM).

The 7900 GRE isn't exactly an unknown entity, as it has been sold with PC builds (and even standalone), in Europe for awhile now as well as China. In general, you can expect better performance and lower power consumption than the 7800 XT (for just $50 more), and about a 20 percent drop off compared to the 7900 XT (for $350 less). 

The 7900 GRE goes on sale starting tomorrow (February 27, 2024) for $549. That's likely to be a sweet spot for a lot of US buyers, so if you're looking to get one, act quickly. And if you want to spend a bit less, AMD is also lowering the US price of the RX 7700 XT to $419, $40 less than the original price, starting today.

Samsung unveils the Galaxy Ring as a way to 'simplify everyday wellness'

After teasing it (again) yesterday, Samsung has finally shown off the Galaxy Ring in physical form at Mobile World Conference (MWC 2024) and revealed some additional details. The device is of course centered around health and wellness and will come in three colors, platinum silver, gold and ceramic black. It's set to go on sale later this year.

Samsung didn't say much about the Galaxy Ring when it first displayed a render of the device at Unpacked last month. All we knew at the time was that it would be a wellness-oriented wearable positioned to rival Oura and that it would have a suite of unknown sensors. 

Journalists weren't allowed to photograph it today, but some additional images from Samsung show it to be a chonky, concave ring about the same size as the Oura, according to a supplied image (below). The extra girth isn't surprising, given the electronics cached inside. 

Still, The Verge noted that it was lighter than expected and will be offered in sizes 5 to 13, marked S through XL inside the band. The size of the battery (and thus time between charges) will vary depending on the size, ranging from 14.5mAh to 21.5mAh. Battery life is unknown, but the Oura can go up to seven days between charges.

According to a blog from Samsung VP Dr. Hon Pak, the ring will track sleep based on heart rate, movement and breathing, then provide users advice based on that. The company will also glean data from partner Natural Cycles, which already does fertility tracking on the Galaxy Watch, matching a key Oura feature. 

The Galaxy Ring will also offer a new tool called My Vitality Score that measures alertness so users can see if they're at their best. Feedback will be available via "Booster Cards" that offer science-based tips using sleep and other data gathered by the device.

The Galaxy Ring will be part of the Samsung Health ecosystem and be compatible with the Galaxy Watch. That means you'll be able to use both devices at once to track your health and get higher quality data as a result. That said, the advantage of a ring wearable is that it's far less annoying to sleep with it.

We'll learn more in the months ahead, including the exact sensor suite, pricing and sale date. The Galaxy Ring will only be compatible with Samsung Galaxy phones, though the company is planning to make it work with other Android devices later on. iOS compatible is still to be determined, though, Pak said.

Google Pay is shutting down in the US later this year

Google Pay was largely replaced by Google Wallet back in 2022, but it has still been operating in several countries, including the US. Now, the search giant has announced that Pay will be discontinued stateside on June 4, 2024 in a push to simplify its payment apps. After that, it will only be available in Singapore and India due to the "unique needs in those countries," Google wrote in a blog. 

As part of the deprecation, Google will be removing peer-to-peer (P2P) payments, managing your balance and "find offers and deals." For the latter, it recommends using the new deals destination on Search. Users will still be able to transfer their Google Pay (GPay) balance to a bank account after June 4, 2024 using the Google Pay website.

Google Wallet has now largely replaced GPay, with five times as many users in 180 countries, the company said. That's because it can handle more than just payments — on top of credit and debit cards, it stores transport passes, state IDs, driver's licenses, virtual car keys and more.

Google's payment system has been a mess over the years. It started off as Google Wallet, which was launched in 2011. At the time, it was a tap-to-pay system that came out years ahead of Apple Pay (2014), supported by Mastercard and retailers like Macy's. 

Meanwhile, Android Pay came out in 2015, then that was integrated with Google Wallet in 2018 and rebranded as Google Pay. In addition, the company originally had a Google Wallet card (killed in 2016) that was effectively a prepaid debit card usable with any retailers that accepted Mastercard. Now everything is back under the Google Wallet umbrella — unless the company changes its mind again.

Pansonic's powerful Lumix S5 II is $800 off with a prime lens

Panasonic's powerful full-frame mirrorless camera, the S5 II, is on sale at Amazon and B&H Photo Video at the lowest price we've seen yet. You can grab one with an 85mm f/1.8 prime lens for as little as $1,796, a savings of $800 over buying both separately — effectively giving you a discount on the camera and a free lens to boot. 

As I wrote in my review, the 24-megapixel S5 II was already a great value at $2,000 thanks mainly to its strength as a vlogging camera. It's the company's first model with a phase-detect autofocus system that eliminates the wobble and other issues of past models. 

Panasonic also brought over its new, more powerful stabilization system from the GH6. And it has the video features you'd expect on a Panasonic camera, like 10-bit log capture up to 6K, monitoring tools and advanced audio features. With the generous manual controls and excellent ergonomics, it's an easy camera to use. It also comes with a nice 3.68-million dot EVF and sharp rear display that full articulates for vlogging. 

For photos, it's reasonably fast and great in low light, thanks to the dual native ISO system. Other features include dual high-speed SD card slots and solid battery life, particularly for video. The main downside is noticeable rolling shutter, but that shouldn't be a dealbreaker for most users — particularly at that price.

Google's sign-in and sign-up pages have a new look

After teasing it for the past couple of weeks, Google is rolling out a new sign-in page with a slightly cleaner design. The changes are small and don't affect functionality, but it's something that users encounter often, and Google has been using the previous version since it changed its logo, as far as I can see. 

The refresh puts the sign-in (and sign-up) page more in line with the company's Material Design ethic introduced back in 2014. To that end, it's now aligned left (instead of centered) and features an orientation that automatically adjusts to your screen's size — so it's wider on PC screens and narrower on smartphones. It shows up on all types of devices, but may not appear on older browsers, the company said. 

The biggest previous change Google made to its sign-in page was putting password entry onto a second page back in 2015. That update was made "in preparation for future authentication solutions that complement passwords," and to reduce confusion among people who have multiple Google accounts, it said at the time. 

Google emphasized that the change will be permanent, much like the switch to Gmail's integrated view. The rollout will be fairly gradual, starting on February 21 and set for completion by March 4, 2024.

Watch the first Nintendo Direct of 2024 here at 9AM ET

Nintendo's about to kick off its first event of the year with the Direct Partner Showcase focused on upcoming third-party games for Switch. We could see the first news about Xbox titles like Pentiment coming to other platforms and maybe, hopefully more about the much-delayed Hollow Knight sequel, Silksong. The 25-minute presentation kicks off at 9AM ET today (February 21) and you can watch it below.

As mentioned, today's Direct could be more significant than a typical showcase. Last week, Microsoft announced that it would begin bringing some of its exclusive titles to "other consoles," likely meaning the Switch and Sony's PlayStation 5.

Microsoft didn't elaborate much more than that, but rumors cite Hi-Fi Rush, Pentiment, Sea of Thieves and Grounded as likely first titles moving to other platforms. The only thing we know for certain, though, is that Starfield and Indiana Jones and the Great Circle will remain Xbox exclusives for now. 

Apart from that, there are a few upcoming third-party games without release dates including Contra: Operation Galuga and Penny's Big Breakaway, so Nintendo might give us more info about those. We're also hoping to hear about Hollow Knight: Silksong which, last we heard in May 2023, was delayed and had no updated release window.

Appeals court overturns $1 billion copyright lawsuit against Cox

An appeals court has blocked a $1 billion copyright verdict from 2019 against US internet service provider Cox Communications and ordered a retrial, Arts Technica has reported. A three-judge panel ruled unanimously that Cox didn't profit directly from its users' piracy, rebutting claims from Sony, Universal and Warner. 

The judges did affirm the original jury's finding of willful contributory infringement from the trial, first announced back in 2018. To that effect, they ordered a new damages trial that may reduce the size of the award.

"We reverse the vicarious liability verdict and remand for a new trial on damages because Cox did not profit from its subscribers' acts of infringement, a legal prerequisite for vicarious liability," the panel wrote. It added that "no reasonable jury could find that Cox received a direct financial benefit from its subscribers' infringement of Plaintiffs' copyrights." 

Cox allegedly refused to take "reasonable measures" to fight piracy, according to the original allegations. Internet providers are supposed to terminate the accounts of offending users, but the ISP only conducted temporary disconnections and warned some users more than 100 times. The labels claimed it even instituted a cap on accepted copyright complaints and cut back on anti-piracy staffers.

However, the judges said that Sony offered no causal connection between infringement and higher revenues for Cox. "No evidence suggest that customers chose Cox's Internet service, as opposed to a competitor's, because of any knowledge or expectation about Cox's lenient response to infringement." 

Under the US Digital Millennium Copyright Act (DMCA) and EU rules, ISPs enjoy "safe harbor" protections that shield them from liability for user actions. However, that only holds if they comply with specific requirements and address copyright violations promptly — and in this case, Cox didn't do that, the judges said. 

"The jury saw evidence that Cox knew of specific instances of repeat copyright infringement occurring on its network, that Cox traced those instances to specific users, and that Cox chose to continue providing monthly Internet access to those users... because it wanted to avoid losing revenue," the ruling states. The case is now headed back to a US District court.
