Apple is now selling Watch Series 9 and Ultra 2 with disabled blood oxygen monitor

If you're in the US, any Watch Series 9 or Ultra 2 model you buy from Apple will no longer have a functional blood oxygen monitoring feature. Apple failed to convince the court to allow it to keep selling the aforementioned models while it's appealing a ruling by the US International Trade Commission (ITC). If you'll recall, the commission found that Apple had violated patents owned by medical technology company Masimo, which accused the iPhone-maker of infringing on its intellectual properties related to light-based blood-oxygen monitoring. The ITC ordered the company to stop selling the contested watches.

Apple pulled the Watch models from its website and stores in December before the the ban took effect as a preemptive measure. A few days later, though, the company put them back up for sale after a federal appeals court in Washington D.C. granted it a temporary pause on the import and sales ban. Now, the appeals court has lifted the stay and ordered Apple to stop selling both models again by 5PM ET on January 18. 

The company, however, is able to skirt the ban, because the US Customs and Border Protection (CBP) recently decided that redesigned watches without a pulse oximetry functionality fall outside the scope of the ITC's ruling. In a statement sent to 9to5Mac, Apple said it believes "the US Court of Appeals for the Federal Circuit should reverse the USITC’s decision" and that it strongly disagrees with it and the resulting orders. "Pending the appeal, Apple is taking steps to comply with the ruling while ensuring customers have access to Apple Watch with limited disruption," the spokesperson added. "These steps include introducing a version of Apple Watch Series 9 and Apple Watch Ultra 2 in the United States without the Blood Oxygen feature." The company also clarified that there "is no impact to Apple Watch units previously purchased that include the Blood Oxygen feature."

The modified watches will still have the blood monitoring app, Apple told the publication, but you will get a message that says it's no longer available when you tap on it. That message also tells you to go the Health app on your iPhone to learn more, where you'll then see a link to a support article on the company's website. 

Even before the ITC's ban took effect, Apple was already reportedly scrambling to create a software update that would allow it to sell the devices involved. Clearly, the company was able to develop a solution in time for the stay to be lifted. While the ban isn't officially taking effect until the afternoon of January 18, you'll already see a note that says "Apple Watch Series 9 and Ultra 2 no longer include the blood oxygen feature" when you visit the company's website and access either model's product page. Engadget reached out to Apple, and while it confirmed the resumed US availability of both watch models, it refused to comment on the matter.

WhatsApp Channels now let owners send voice messages

WhatsApp has introduced new features Channels can use to interact with their followers. The biggest one, perhaps, is voice updates. Channel admins and owners, such as celebrities, can now send voice messages to their group. Meta says Puerto Rican rapper Bad Bunny was the first celebrity to test it out, but it's rolling out the feature broadly today. Voice updates is one of WhatsApp's most popular features, probably because it allows users to send messages without having to type, even while they're driving or doing something else. Apparently, WhatsApp users send 7 billion voice messages on the app every day, so it was most likely a very easy decision for Meta to bring the feature to Channels. 

In addition to voice updates, admins can now also share polls in chat that their followers can answer. Plus, WhatsApp now allows Channels to have as many as 16 administrators if they want to make sure that their followers are always up to date with the latest news. As for fans, they'll now be able to share a Channel update as their Status, which is the messaging service's version of Instagram Stories. Since it's possible to share voice notes as a WhatsApp Status, that presumably means they can also share a Channel voice update if they want. All of these features are making their way to WhatsApp users around the world.

Google now admits it could collect data in Chrome's Incognito mode

When users open an Incognito browser on Chrome, they'll see a notification warning them that other people using their device won't be able to see their activity but that their downloads, bookmarks and reading items will still be saved. Now, Google has updated that disclaimer in Chrome's experimental Canary channel, shortly after agreeing to settle a $5 billion lawsuit accusing it of tracking Incognito users. As first noticed by MSPowerUser, the company has tweaked the disclaimer in Canary to add language that says Incognito mode won't change how websites collect people's data.

"Others who use this device won’t see your activity, so you can browse more privately," the new disclaimer reads. "This won't change how data is collected by websites you visit and the services they use, including Google. Downloads, bookmarks and reading list items will be saved." The publication spotted the updated warning in Canary on Android and Windows, and we can confirm that the same language appears in the version of Chrome for Mac. 

Google was hit with a lawsuit in 2020, accusing it of tracking users' activities even if they're on Incognito mode. The plaintiffs told the court that the company used tools like its Analytics product, apps and browser plug-ins to monitor users. They also argued that by tracking users on Incognito, Google was giving people the false belief that they could control the information they're willing to share. A Google spokesperson explained at the time that the mode could only hide a user's activity on the device they're using but that their information could still be collected. That's not clearly communicated in the current disclaimer for the public version of Chrome, but it looks like that could change in the near future.

Uber shuts down alcohol delivery service Drizly three years after its purchase

Back in 2021, Uber purchased Drizly for $1.1 billion shortly after it reported that its food delivery segment kept its losses manageable during the pandemic. Three years later, the company is shutting down the US-based alcohol delivery service, Axios has reported. Pierre-Dimitri Gore-Coty, Uber's SVP of delivery, told the publication that the company has decided to close the business and to focus on its "core Uber Eats strategy."

In SEC's announcement of the acquisition, Drizly was described as a service that "works with thousands of local merchants to provide consumers with an incredible selection of beer, wine, and spirits with competitive, transparent pricing." Uber integrated Drizly's offerings into its Eats app, but the alcohol delivery service maintained a separate application of its own. 

"After three years of Drizly operating independently within the Uber family, we've decided to close the business and focus on our core Uber Eats strategy of helping consumers get almost anything — from food to groceries to alcohol — all on a single app," Gore-Coty said in a statement. "We're grateful to the Drizly team for their many contributions to the growth of the BevAlc delivery category as the original industry pioneer."

It's unclear if Drizly's cybersecurity issues played a role in Uber's decision. Drizly previously confirmed a data breach in 2020 that exposed the information of 2.5 million customers. After Uber's acquisition, the Federal Trade Commission found that Drizly CEO James Cory Rellas was alerted about the company's security issues way back in 2018. The agency determined that the delivery service failed to implement the proper safeguards to protect its users despite claiming it had done so and that its poor security practices made the data breach possible. It ordered Drizly to destroy any personal data it collected that had nothing to do with its services and to refrain from collecting them in the future. The FTC also required Rellas to implement information security programs at any company he joins or forms where he takes on the role as CEO. Either way, Drizly is gone, but Uber seems to intend to continue delivering alcohol to its customers.

Facebook was inundated with deepfaked ads impersonating UK's Prime Minister

Facebook was flooded with fake advertisements featuring a deepfaked Rishi Sunak ahead of the UK's general election that's expected to take place this year, according to research conducted by communications company Fenimore Harper. The firm found 143 different ads impersonating the UK's Prime Minister on the social network last month, and it believes the ad may have reached more than 400,000 people. It also said that funding for the ads originated from 23 countries, including Turkey, Malaysia, the Philippines and the United States, and that the collective amount of money spent to promote them from December 8, 2023 to January 8, 2024 was $16,500. 

As The Guardian notes, one of the fake ads showed a BBC newscast wherein Sunak said that the UK government has decided to invest in a stock market app launched by Elon Musk. That clip then reportedly linked to a fake BBC news page promoting an investment scam. The video, embedded in Fenimore Harper's website, seems pretty realistic if the viewer doesn't look too closely at people's mouths when they speak. Someone who has no idea what deepfakes are could easily be fooled into thinking that the video is legit.

The company says this is the "first widespread paid promotion of a deepfaked video of a UK political figure." That said, Meta has long been contending with election misinformation on its websites and apps. A spokesperson told The Guardian that the "vast majority" of the adverts were disabled before Fenimore Harper's report was published and that "less than 0.5 percent of UK users saw any individual ad that did go live."

Meta announced late last year that it was going to require advertisers to disclose whether the ads they submit have been digitally altered in the event that they're political or social in nature. It's going to start enforcing the rule this year, likely in hopes that it can help mitigate the expected spread of fake news connected to the upcoming presidential elections in the US.

OpenAI's policy no longer explicitly bans the use of its technology for 'military and warfare'

Just a few days ago, OpenAI's usage policies page explicitly states that the company prohibits the use of its technology for "military and warfare" purposes. That line has since been deleted. As first noticed by The Intercept, the company updated the page on January 10 "to be clearer and provide more service-specific guidance," as the changelog states. It still prohibits the use of its large language models (LLMs) for anything that can cause harm, and it warns people against using its services to "develop or use weapons." However, the company has removed language pertaining to "military and warfare."

While we've yet to see its real-life implications, this change in wording comes just as military agencies around the world are showing an interest in using AI. "Given the use of AI systems in the targeting of civilians in Gaza, it’s a notable moment to make the decision to remove the words ‘military and warfare’ from OpenAI’s permissible use policy,” Sarah Myers West, a managing director of the AI Now Institute, told the publication. 

The explicit mention of "military and warfare" in the list of prohibited uses indicated that OpenAI couldn't work with government agencies like the Department of Defense, which typically offers lucrative deals to contractors. At the moment, the company doesn't have a product that could directly kill or cause physical harm to anybody. But as The Intercept said, its technology could be used for tasks like writing code and processing procurement orders for things that could be used to kill people. 

When asked about the change in its policy wording, OpenAI spokesperson Niko Felix told the publication that the company "aimed to create a set of universal principles that are both easy to remember and apply, especially as our tools are now globally used by everyday users who can now also build GPTs." Felix explained that "a principle like ‘Don’t harm others’ is broad yet easily grasped and relevant in numerous contexts," adding that OpenAI "specifically cited weapons and injury to others as clear examples." However, the spokesperson reportedly declined to clarify whether prohibiting the use of its technology to "harm" others included all types of military use outside of weapons development.

Google changes its Play Store policy to allow more real-money games

There may be a lot more real-money gaming (RMG) apps available in the Google Play Store before the year ends — at least in certain locations. Google initially started allowing apps that deal with real money in its store back in 2021, but only if they fall under a game type that's regulated by the government. Now, the company has announced that it's tweaking its rules to allow more "game types and operators not covered by an existing licensing framework." That will open the Play Store to games that aren't that popular or aren't played widely enough for local governments to create laws around them. 

Google says it conducted several pilot programs in different parts of the world since 2021 to determine how to support more real-money game operators and game types. In India, for instance, its pilot tests included apps offering Rummy card games and Daily Fantasy Sports. The company will enforce its new policy in India, Mexico and Brazil starting on June 30. After that, operators part of its pilot programs can release their current applications — and other types of real-money gaming apps — like any other developer, so long as they're in compliance with local laws. 

The company said it has plans to expand the availability of RMG apps in other regions in the future, but it clarified that its age requirements to be able to access those games will remain in place. Also, developers will still be required to geo-fence their products, so that they'll only be available where they're legal. It has also revealed that it's "evolving its service fee model" for real-money gaming apps to "help sustain the Android and Play ecosystems." As 9to5Google notes, RMG apps can't use Google Play billing, but that's likely set to change if the company intends to take a cut of developers' earnings.

Meta reportedly laid off 60 technical program managers at Instagram

When Mark Zuckerberg announced last year that Meta was laying off 10,000 workers, he described 2023 as a "year of efficiency" defined by removing layers of middle management to create a "leaner org." Turns out the company still isn't done restructuring its organization. According to Business Insider, Meta recently told at least 60 of its employees at Instagram that it's eliminating their position altogether. The affected employees are technical program managers, the people who go in between Meta's tech workers, including its engineers, and the higher level product managers.

Based on posts on Blind, an app for tech employees, and on LinkedIn seen by the publication, the workers losing their jobs are given the chance to be interviewed to be considered for a position as product manager. By March, those who chose to leave or weren't given a new role will no longer have a job with Meta. The company slashed 11,000 jobs in the fall of 2022 in addition to the 10,000 workers it laid off last year in an effort to cut costs. It also issued a hiring freeze and closed thousands of open roles it was originally hiring for. 

"A leaner org will execute its highest priorities faster. People will be more productive, and their work will be more fun and fulfilling," Zuckerberg said last year. It's unclear if Meta has already lifted its hiring freeze, but it's expected to do so only after it's done with restructuring.

Valve's new guidelines will allow for more AI content in games

Valve has introduced new rules to abide by that will allow the company to add more games with AI content to its Steam gaming platform. To start with, it's updating its content survey form for developers so that they can give the company a description of how they use artificial intelligence in their games. If they used AI tools to generate art, code, sound or any other kind of content for their title, developers must ensure that they do not include anything illegal or anything that infringes on someone else's copyright. Valve says it will evaluate each game and check if the developer has submitted truthful information. 

For live-generated AI content, developers have to tell the company what kind of guardrails they've put up to prevent their games from creating anything considered illegal. And since Valve will not be able to review all content games create in real time, it's launching a new system on Steam that will allow players to easily send in a report. If a player sees anything they believe should've been caught by appropriate guardrails, they can use Steam's new in-game overlay to notify the company.

Valve said it will also be transparent with gamers when it comes with what kind of AI content a developer's title has by including their disclosure on their Steam store page. The company explained that the new rules are a result of it improving its "understanding of the landscape and risks" in the AI space. Last year, Valve admitted that it was still "working through" how to account for AI content in its review process after developers complained that the company was rejecting their submissions. It needed "some time to learn about the fast-moving and legally murky space of AI technology," Valve clarified in its new post. The company said it still can't release games with live-generated adult sexual content right now, but that it will revisit its rules as it learns more about the technology and as the legal issues surrounding it evolves.

Hyundai shows off its updated S-A2 air taxi at CES 2024

Hyundai has debuted its new air taxi concept, the S-A2, at CES 2024 in Las Vegas. The electric vertical takeoff and landing (eVTOL) vehicle is a follow-up to the S-A1 model it introduced at the same event back in 2020. Hyundai still envisions the S-A2 as an every day transportation solution for urban areas, one that could get passengers from point A to point B a lot more quickly than if they'd traveled by car or bus and had to contend with traffic.

The S-A2 has a cruising speed of 120mph upon reaching an altitude of 1,500 feet and was designed to fly short trips between 25 to 40 miles. It has eight rotors and an electric propulsion architecture that the company says can operate "as quietly as a dishwasher" unlike loud traditional helicopters. Inside, the vehicle has seats for a pilot and four passengers, and it has lighting that provides visual cues, such as where to enter and exit. For safety purposes, it has a lot of redundant components, such as its powertrain and flight controls, which can take over if the main ones malfunction. 

Hyundai's air mobility company Supernal is hoping to achieve commercial aviation safety levels and to enter the market with an eVTOL vehicle by 2028. We might see future versions of the concept in the next CES events before that year — or after, if the company has to adjust its timeline. If and when Supernal does make it to market, it intends to use Hyundai's mass production capabilities to manufacture its eVTOLs and make sure its business is cost-effective.
